Welcome to GozoGraphics.com (the “Site”). The Site is operated by Gozo Graphics Ltd. (“GozoGraphics”, “we”, “us”, “our”). By using the Site you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please refrain from using the Site. We may update these Terms from time to time without prior notice. Continued use of the Site constitutes acceptance of the updated Terms. Section A applies specifically to orders; Section B applies to all products and services available through the Site.

Section A — Terms and Conditions of Order

1) GozoGraphics Satisfaction Guarantee

  • If you are not satisfied with your purchase, contact Customer Service at +356 9933 6964 or sales@gozo.graphics within 30 days from receipt (or scheduled arrival).
  • We run orders through an internal checklist. You are responsible for correcting issues we identify, or authorising us to proceed “as is”.
  • The guarantee excludes circumstances listed under clauses 1.1 and 1.2 below.

1.1) File Submissions — Exclusions

  • Spelling, punctuation, or grammatical errors made by you.
  • Inferior quality or low-resolution of uploaded images.
  • Design errors or colour selection errors introduced in your artwork.
  • Errors in user-selected options (product type, size, finishing, quantity).
  • Incorrect dimensions, image orientation, or files not meeting GozoGraphics specifications.
  • Colour match guarantee where no hardcopy proof was approved.
  • Delivery delays due to improperly prepared files.
  • Duplicate orders submitted by the customer.
  • Incorrect file layout for manufacturing of signs, 3D prints, etc.

1.2) Shipping and Delivery — Exclusions

  • Incorrect shipping address, undeliverable packages/third-delivery attempts, or other errors created by you.
  • Damage to products arising after delivery to you.
  • The satisfaction guarantee does not apply to shipping claims. We will reprint orders damaged or lost by the carrier.
  • We may require return of the original order before reprinting or refunding.
  • We are not responsible for any damages or claims incurred by you or your business resulting from receiving printed materials that are defective or incomplete, or that you receive later than the estimated delivery date.

2) Payment

  • Prices are in Euros (€) unless otherwise noted. By submitting a request, you agree all charges, taxes, and shipping/processing fees will be charged to your selected payment method.
  • Once a job is approved and “sent to press”, no changes to artwork, job characteristics, or turnaround are allowed.
  • After a job reaches GozoGraphics’ prepress department, you are responsible for the full amount plus taxes, shipping, and processing fees (unless otherwise noted).
  • No work proceeds until full payment is received.

2.1) Approved Payment Methods

  • BOV Mobile or Revolut.
  • Direct payment via payment gateway.
  • Bank transfer.

2.2) VAT Policy

Gozo Graphics Ltd. is required to collect and remit VAT on all sales. An 18% VAT rate is charged on each product and included in the price. Fiscal receipts are provided upon pickup or with delivery documents once payment is effected.

2.3) Late/Non-Payment & Remedies

If any amount remains unpaid, we may suspend production, withhold deliverables, and postpone shipment or collection until payment is received. Unpaid jobs over 60 days after delivery/notice that the job is ready: to the fullest extent permitted by applicable law and without prejudice to mandatory consumer rights, we may withhold or dispose of materials and suspend or revoke licences granted for production until payment is received. We may also refer unpaid accounts to collection and pursue any lawful remedies (including court proceedings) to recover amounts due, together with any court-awarded costs and statutory interest where applicable. For business customers only, you agree that failure to pay may result in the transfer or assignment of rights in the specific production files created by GozoGraphics solely to secure payment of the outstanding charges. Nothing in this clause transfers ownership of your pre-existing intellectual property. See also clause 6 (Shipping and Arrival Times) regarding uncollected orders.

3) Colour Accuracy and Hardcopy Proofs

  • We reproduce colour from submitted print-ready files as closely as possible, but exact matches cannot be guaranteed due to printing limitations and neighbouring ink requirements.
  • Colour accuracy is guaranteed to be within 90% of the final approved proof; otherwise, we will reprint at no charge.
  • No guarantee if you did not request a hardcopy proof or purchased a product without a hardcopy proof option.
  • We accept no responsibility for colour variations between your submitted images and the actual artwork/product. For guidelines, call +356 9933 6964.

3.1) Binding Proof Standard. A hardcopy proof is the only colour reference we treat as binding for colour-tolerance purposes. Screenshots, PDFs, and on-screen previews are not binding proofs.

3.2) Live Content Previews

Any live or on-screen product previews are indicative only and may differ from the final physical product due to device display settings, print processes, substrate characteristics, and finishing tolerances. Previews are not colour-accurate proofs and are subject to change on the finished product.

4) Artwork Files

  • You are responsible for the accuracy of your print-ready files and must proofread them carefully before submission.
  • You certify you have rights to use the image(s) in your files. Do not send one-of-a-kind originals by mail; we are not responsible for loss or damage.
  • Do not upload material that could give rise to civil or criminal liability or infringe privacy, publicity, copyright, or other intellectual property rights without permission. We cannot print sexually explicit (including photographic genitals) or violently explicit materials.
  • Files may be stored for future reference; they remain your intellectual property and will be deleted upon written request to info@gozo.graphics identifying the files.
  • We will not sell client-submitted images/artwork to other customers. Images of finished products may be used for marketing campaigns, advertising, and social media posts.
  • Non-payment: see clause 2.3. If unpaid for 60+ days after delivery/notice, we may suspend/withhold deliverables and, as permitted by law and for business customers only, require assignment of GozoGraphics-created production-file IP to secure the debt.

4.1) Handling of Personally Uploaded Files

Files you upload are handled with care and are shared internally only as needed to process your order and provide the Service. We periodically perform batch housekeeping to optimise storage, during which older uploads may be deleted. If you want a specific file removed from our servers, you may request deletion at any time by emailing info@gozo.graphics and identifying the file(s). We will honour your request unless we must retain the file to comply with legal obligations (e.g., accounting, fraud prevention, or lawful claims). This supports your GDPR right to erasure where applicable.

4.2) AI-Assisted Processing of Files

To provide and improve print quality (for example, upscaling, denoising, artefact removal, background cleanup, and colour correction), we may use third-party AI/ML tools as part of our production workflow. By uploading files and placing an order, you grant GozoGraphics a non-exclusive, worldwide licence to process your files for the purpose of producing your order and providing related support, which includes using such AI tools as sub-processors under contractual safeguards. We require our service providers to act on our instructions and we do not permit them to use your content to train their models or for their own purposes, unless you explicitly consent or choose an integration that states otherwise. Where you choose or request a specific third-party integration, that provider’s terms may also apply. Subject to applicable law, GozoGraphics is not liable for acts or omissions of independent third-party providers beyond our reasonable control.

Important: Timely payment avoids the above forfeiture of IP rights.

5) Printing Turnaround Time

  • Turnaround begins once your order is placed and your print-ready files are uploaded. Typical turnaround is 3–7 working days; framed prints 7–15 working days. Check the item description for specifics.
  • If files do not conform to our requirements, your job is set to “On Hold” and turnaround resets once corrected files are received.
  • For jobs without complete digital source files, turnaround starts when we have the print-ready file(s).
  • If your job/proof is approved by 6:00 p.m. CET, turnaround begins that business day. (Example: 3-day turnaround approved by 1:00 p.m. CET Tuesday ships by end of business Friday.)
  • Facilities are closed Saturdays, Sundays, and major holidays; these days do not count toward turnaround. Turnaround excludes shipping time.

5.1) Processing & Delivery Estimates

All processing times, dispatch dates, and delivery dates shown on the Site or in communications are estimates and may vary by product and order complexity. Estimated dates are not guaranteed and exclude delays outside our control (e.g., carrier issues, weather events, supply interruptions).

6) Shipping and Arrival Times

  • Transit times vary. We assume no responsibility for delays caused by carriers, weather, or unforeseen events.
  • Pick-up orders are held for 30 days. After 30 days, paid orders may be disposed of; unpaid balances may be referred to our legal department for collection.

7) Miscellaneous (Orders)

  • All sales are final unless otherwise noted. No refunds once production starts (i.e., we received your files and payment and your job is in production).
  • Orders not sent to press within 180 days are eligible for a full refund; after 180 days, no refund is available.
  • Your printed product or images will not be used in marketing without your prior written consent except as stated in clause 4 regarding finished product images.

8) Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, labour disputes, supply interruptions, carrier failures, governmental actions, or utility outages.

9) Limitation of Liability (Orders)

IN NO EVENT WILL GOZOGRAPHICS BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR OTHER DAMAGES, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. GOZOGRAPHICS’ ENTIRE LIABILITY UNDER, FOR BREACH OF, OR ARISING OUT OF PROVIDING THE SERVICES HEREUNDER IS LIMITED TO A REFUND OF THE FEES PAID FOR THE PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM. IN NO EVENT SHALL GOZOGRAPHICS BE LIABLE FOR YOUR COST OF PROCURING SUBSTITUTE GOODS.

10) Indemnity (Orders)

You will defend and hold GozoGraphics harmless from claims, costs, expenses (including reasonable attorneys’ fees), liabilities, or losses arising from our use (acting as your agent) of copy, photographs, or illustrations alleged to be degrading, libellous, or harmful, or to infringe intellectual property rights; or from actions of your employees resulting from any mailing.

Section B — General Terms and Conditions

1) Copyright Notice

All Site content (the “Content”) is the intellectual property and copyrighted works of GozoGraphics and/or third-party providers (“Providers”). Reproduction or storage is subject to the Copyright Act (Maltese law).

2) Corporate Identification and Trademarks

“GozoGraphics”, “GozoGraphics.com”, and other marks are trademarks of GozoGraphics in Malta. You may not use or modify them without prior written consent. Use as a “hot” link requires pre-approval.

3) Use Restrictions

  • Use the Site only to make legitimate purchase requests (“Requests”); do not make speculative, false, or fraudulent Requests.
  • No robots or other automated means of access unless specifically permitted.
  • You represent you are of sufficient legal age and will keep your information current, complete, and accurate.
  • Placing a Request in a false name or with invalid payment details is unlawful.
  • Permission is granted to copy/print portions of the Site solely as a shopping resource; all other use requires prior written consent.

4) Email

We may not respond to all submissions. We assume no responsibility for reviewing unsolicited ideas and have no liability for similarities with future programs. You are responsible for material you submit. Do not reveal trade secrets or confidential information. All rights to materials and ideas submitted become GozoGraphics’ exclusive property.

5) Privacy

Your use of the Site is governed by our Privacy Policy (below). By using the Site, you confirm you have read and agree to it.

6) Disclaimer of Warranty

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. OPERATION MAY NOT BE UNINTERRUPTED OR ERROR-FREE.

7) General Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOZOGRAPHICS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AFFILIATES (“COVERED PARTIES”) ARE NOT LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR CONNECTED WITH USE OF THIS SITE OR DELAY/INABILITY TO USE THIS SITE, EVEN IF ADVISED OF THE POSSIBILITY. If a Covered Party is found liable, liability shall not exceed the fee or charge assessed by GozoGraphics for the Request.

8) Indemnification

You agree to defend, indemnify, and hold harmless GozoGraphics and its affiliates from any and all claims, damages, costs, and expenses (including attorneys’ fees) arising from or related to your use of the Site. You certify you own or are licensed to use images reproduced as part of your order.

9) Third Parties

If you submit Requests for or on behalf of a third party, you are responsible for accuracy and must inform them of these Terms and applicable rules/restrictions. You agree to indemnify Covered Parties for failures by you or the third party to fulfil obligations. You are directly responsible for any Request submitted, including fees, charges, and performance.

10) User Comments, Feedback, and Other Submissions

All comments, feedback, suggestions, and ideas (“Comments”) become GozoGraphics’ exclusive property and may be used worldwide in any medium without your specific consent. No obligations to maintain confidentiality, pay compensation, or respond.

11) Links to Other Websites and Services

Third-party links are provided for convenience. We do not guarantee their accuracy or completeness and are not responsible for their content or practices.

12) Termination of Usage

Access to all or part of the Site may be terminated or suspended at any time, without notice and for any reason.

13) Miscellaneous

Captions are for convenience and do not limit these Terms. Covered Parties are not responsible for errors or delays caused by incorrect email addresses or technical problems beyond their control.

14) Entire Agreement

These Terms, together with the Privacy Policy and any incorporated terms, form the entire agreement and supersede prior understandings. Amendments may be posted on the Site. If any provision is invalid, illegal, or unenforceable, the remaining provisions remain in effect.

15) Governing Law and Jurisdiction

The laws of Malta govern these Terms. You consent to the exclusive jurisdiction and venue of the courts located in Victoria, Gozo, Malta.

Privacy Policy (GDPR-Aligned)

This Privacy Policy explains how Gozo Graphics Ltd. (“we”, “us”, “our”) collects and processes personal data when you use GozoGraphics.com, and explains your rights under the EU/EEA GDPR and Maltese law. This version consolidates and clarifies the policy dated January 07, 2020 without removing information, while adding GDPR-required disclosures.

2) Scope and Definitions

Terms such as Personal Data, Processing, Controller, Processor, Third Party, Affiliate, and Service Provider have the meanings in GDPR. “Account” refers to any account you create to access parts of the Service.

3) Categories of Personal Data We Process

  • Identification & contact: full name, email, phone/telephone number, postal address (including town/city/county/region/postcode), country.
  • Demographic data (where provided): gender, date of birth.
  • Account data: login credentials and preferences (if you create an account).
  • Order & transaction data: products/services purchased, payment status, invoices, VAT details.
  • Usage/device data: IP address, browser type/version, device identifiers, pages visited, timestamps, time spent, diagnostic data.
  • Cookies & similar technologies: identifiers used for analytics/advertising where consented (e.g., pixel IDs, hashed email/phone, External ID for Meta Pixel).

4) Purposes and Legal Bases

  • Provide/maintain the Service (including accounts) and produce orders using AI-assisted tools where applicable: Art. 6(1)(b) contract; Art. 6(1)(f) legitimate interests (quality, efficiency, fraud prevention).
  • Process and fulfil orders; support; manage requests: Art. 6(1)(b) contract.
  • Service messages, security updates: Art. 6(1)(b) contract; Art. 6(1)(c) legal obligations where applicable.
  • News/special offers about similar goods/services: Art. 6(1)(f) legitimate interests or Art. 6(1)(a) consent where required (opt out any time).
  • Security/fraud prevention/misuse monitoring: Art. 6(1)(f) legitimate interests.

About Cookie Controls & Third-Party Plugins

We use a consent-management platform to control non-essential cookies. You can withdraw or change your cookie consent at any time via our Cookie Policy (EU) page or by clearing cookies in your browser. If a third-party component fails or is blocked, previously given consent on your device or browser profile may still allow certain embeds or pixels to load until you change your preferences. We review our configuration on a reasonable-efforts basis and will remediate issues promptly.

6) Sharing of Personal Data

These act under our instructions and GDPR contracts. We do not permit providers to train their models on your content unless you explicitly consent or you choose an integration that states otherwise.
  • Advertising & analytics partners (consent-based): we may share limited identifiers and event data (e.g., pixel IDs, hashed email/phone, External ID, and page/view/purchase events) to measure performance and personalise ads only if you consent to marketing/advertising cookies.
  • Affiliates: that honour this Privacy Policy.
  • Business partners: to offer certain products, services, or promotions.
  • Corporate transactions: merger, sale of assets, financing, or acquisition (with notice of ownership change).
  • Public authorities: where required by law or to protect rights, security, and safety.
  • Note:
  • Data sent to advertising/analytics partners may involve international transfers outside the EU/EEA; we rely on appropriate safeguards (e.g., Standard Contractual Clauses) and obtain your consent before setting non-essential cookies or pixels.

7) International Data Transfers

Data may be processed in Malta and other countries where Service Providers are located. For transfers outside the EU/EEA, we implement appropriate safeguards required by GDPR (e.g., European Commission Standard Contractual Clauses) and additional measures where necessary.

8) Retention

We retain personal data only as long as necessary for the purposes set out herein, including compliance with legal obligations (e.g., tax/accounting), dispute resolution, and enforcement. Usage data may be retained for a shorter period unless needed to improve security or functionality, or required by law.

9) Your GDPR Rights

9.1) Automated Decision-Making & Profiling

We do not make decisions that produce legal or similarly significant effects about you solely by automated means. We may use limited profiling (e.g., to tailor marketing) only where you have consented to analytics/advertising cookies. You can withdraw that consent at any time (see Cookies section).

10) Children’s Privacy

  • The Service is not directed to children under 13; we do not knowingly collect their data.
  • Parents/guardians who believe a child provided data should contact us so we can delete it.
  • We may limit processing of users aged 13–18; where consent is required by law, parental consent may be required.

11) Security

We use commercially reasonable measures to protect personal data; however, no method of transmission or storage is 100% secure.

12) Links to Other Websites

Third-party sites are not operated by us. We are not responsible for their content or privacy practices; please review their privacy policies.

13) Changes to this Privacy Policy

We may update this Policy from time to time. We will post updates here and update the “Last updated” date; material changes will be notified as required by law.
